Privacy Policy – Biophilic Vision Moments

1. Controller
The controller responsible for the processing of personal data in connection with the iOS app “Biophilic Vision Moments” is:

2. Scope
This Privacy Policy applies to the iOS app Biophilic Vision Moments.
It describes which data may be processed when using the app, which data remains exclusively on the user’s device, and which external services are used for subscriptions, music features, and video delivery.
3. No Registration and No BV User Account
No user account with Biophilic Vision GmbH is currently required to use Biophilic Vision Moments.
According to the current technical implementation, the app does not transmit the following data to servers operated by Biophilic Vision GmbH:
name
email address
device identifier
Advertising ID / IDFA
location data
personal usage history
search history
music library
payment data
Biophilic Vision currently operates no proprietary user account, analytics, or tracking backend for the app.
4. Data Stored Locally on the Device
Certain settings and convenience features are stored exclusively on the user’s device.
These may include:
favorites
user-created Moment playlists and their names
saved sounds
recently used sounds
internal Moment selections
app settings
information about previously selected music or sounds
This information is not transmitted to servers operated by Biophilic Vision GmbH.
Local storage takes place within the storage area provided by iOS for the app, including local app preferences and UserDefaults.
When the app is deleted, locally stored data within the app container is generally removed from the device. A later restoration through device or system backups cannot be completely excluded from a technical perspective.
5. Apple Music and Music Library
Biophilic Vision Moments can, at the user’s request, be used with Apple Music and/or the music library made available by the user.
For this purpose, the app requests the Apple-provided permission for access to Apple Music and the music library.
Once permission has been granted, the app may process information including:
songs
albums
playlists
titles
artists
Apple Music or media IDs
cover artwork and artwork information
preview information
playback and queue information
The app uses this data solely for music selection, display, and playback within Biophilic Vision Moments.
Search requests to the Apple Music catalog, as well as catalog, library, and playback requests, are processed through Apple services.
Information from the music library is not transmitted to Biophilic Vision.
Biophilic Vision also does not receive direct access to the underlying audio files. Access and playback are provided through Apple’s system functions and MusicKit.
Apple’s privacy policies and terms of use additionally apply to processing performed by Apple.
6. Subscriptions and In-App Purchases
Paid subscriptions to Biophilic Vision Moments are processed through the Apple App Store and Apple’s StoreKitframework.
Apple handles, in particular:
presentation and processing of purchases
payment processing
subscription management
restoration of purchases
management of subscription periods and renewals
verification of existing subscription entitlements
Biophilic Vision does not receive credit card, bank account, or other payment information through the app.
The app uses StoreKit solely to determine whether the user has a valid entitlement to a Biophilic Vision Moments subscription.
At present, the following information is not transmitted to servers operated by Biophilic Vision GmbH:
purchase receipts
transaction IDs
payment information
personal purchase histories
Biophilic Vision currently does not operate its own server-side payment or entitlement management system.
Subscriptions, cancellations, and billing are managed through Apple.
Apple’s terms and privacy policies additionally apply to App Store purchases and subscriptions.
7. Video Streaming via Vimeo
The nature films available in Biophilic Vision Moments are delivered through the video service Vimeo and/or content delivery networks used by Vimeo.
When a user starts a film, the device establishes a direct internet connection to Vimeo and/or the delivery servers used by Vimeo.
In this context, technical information may be processed, including:
public IP address
requested film or video/asset ID
time of requests
duration and volume of requests
technical network and protocol information
client or device information transmitted as part of a normal internet connection
information about transmission quality and bitrate
technical error and request information
This processing is technically necessary to transmit the requested video to the user’s device over the internet.
The app does not add a BV user identifier, email address, advertising ID, or proprietary tracking ID to these video requests.
Biophilic Vision currently does not operate its own streaming server for delivery of the videos. Video delivery takes place directly through Vimeo and/or its technical infrastructure.
Further processing and storage of technical connection data by Vimeo is governed by Vimeo’s privacy policy.
8. External Services and Links
The app uses or may establish connections to the following external services:
Apple
App Store and StoreKit for subscriptions and in-app purchases
MusicKit and Apple Music for music search, music library access, and playback
Apple infrastructure for delivery of media, cover artwork, and other MusicKit content
Vimeo
delivery and streaming of videos included in Biophilic Vision Moments
If the app provides a link to an external app or service, such as Spotify, the respective external service is opened only when the user chooses to use that link. Any subsequent processing is governed by the privacy policy of the respective provider.
9. No Advertising, Tracking, or Analytics
Biophilic Vision Moments currently contains no third-party advertising.
The app currently does not use:
Advertising ID / IDFA
AppTrackingTransparency for tracking across apps or websites
advertising SDKs
analytics SDKs
marketing tracking systems
proprietary telemetry systems
In particular, the app currently does not integrate analytics or tracking services such as Google Analytics, Firebase Analytics, Meta, Adjust, AppsFlyer, or comparable services.
The app also does not currently use a proprietary crash-reporting system that transmits diagnostic data to Biophilic Vision.
10. Permissions
The app may request the iOS permission required to access Apple Music and/or the music library made available by the user.
This permission is required to allow users to select and play their music within Biophilic Vision Moments.
The permission can be managed or revoked through the iOS system settings.
The app currently does not request permissions for:
location
camera
microphone recording
contacts
calendar
health data
photos
cross-app tracking
11. Data Transmission to Biophilic Vision
According to the current technical implementation, the app does not transmit personal usage data to a proprietary backend operated by Biophilic Vision GmbH.
In particular, Biophilic Vision does not receive an individual history showing:
which Moments a specific user has viewed
which music a specific user has searched for
which music tracks a specific user has selected
which personal playlists a user has created
how a specific user navigates within the app
Technically necessary connections to Apple and Vimeo are not affected by this statement.
12. Legal Bases for Processing
Where personal data is processed in connection with providing the app, such processing takes place, where applicable, in particular:
to provide functions and services requested by the user
to perform and manage subscriptions
to technically provide music and video content
to ensure the technical functionality and security of the services used
Where processing is necessary for the performance of a contract or in order to take steps prior to entering into a contract, the legal basis is Article 6(1)(b) GDPR.
Where processing is necessary for the purposes of legitimate interests, the legal basis is Article 6(1)(f) GDPR. The legitimate interest consists in particular in providing the app and its content in a secure, stable, and technically functional manner.
Where processing is based on explicit consent, Article 6(1)(a) GDPR is the legal basis. Consent may be withdrawn at any time with effect for the future.
13. International Data Transfers
When services provided by internationally operating providers such as Apple or Vimeo are used, personal or technical data may be processed outside the European Union or the European Economic Area.
The respective providers are responsible for complying with the data protection requirements applicable to their processing and provide information in their own privacy policies regarding international data transfers and any safeguards used.
14. Data Retention
Biophilic Vision currently does not store personal app usage histories on its own servers.
Data stored locally generally remains on the device until it is:
removed within the app
overwritten by a corresponding app function
removed by deleting the app
For data processed by Apple, Vimeo, or other external providers in connection with their services, the respective providers’ retention periods apply.
15. Deleting the App and Cancelling a Subscription
Deleting Biophilic Vision Moments generally removes locally stored app data contained within the app container from the device.
However, deleting the app does not automatically cancel an existing subscription.
Subscriptions are managed through the user’s Apple ID and/or the Apple App Store and must, where applicable, be cancelled separately through Apple.
Deleting the app also does not automatically delete:
the Apple ID
the Apple Music library
App Store purchase history
subscriptions managed by Apple
technical operational or server logs already generated by external services
16. No BV App Account and No Account Deletion Required
As Biophilic Vision Moments currently does not create a personal BV user account and Biophilic Vision does not store personal app usage histories on its servers, there is currently no server-side BV app account that needs to be separately deleted.
If a personal user account is introduced in the future, this Privacy Policy will be updated accordingly and the necessary functions for managing and deleting such an account will be provided.
17. Rights of Data Subjects
Where the applicable legal requirements are met, data subjects have rights under the General Data Protection Regulation, including in particular the right to:
obtain information about the processing of personal data
rectify inaccurate personal data
request deletion of personal data
restrict processing
data portability
object to certain processing
withdraw consent at any time with effect for the future
To exercise these rights, Biophilic Vision GmbH can be contacted using the contact details provided above.
Where data is processed exclusively by Apple, Vimeo, or another external provider and Biophilic Vision has no access to the relevant personal data, it may be necessary to exercise the respective rights directly with the relevant provider.
18. Right to Lodge a Complaint
Data subjects have the right to lodge a complaint with a competent data protection supervisory authority regarding the processing of their personal data.
19. Security
Biophilic Vision takes appropriate technical and organizational measures to protect data processed in connection with the app against loss, manipulation, and unauthorized access.
Communication with Apple, Vimeo, and other integrated internet services uses the security mechanisms provided by iOS and the respective services.
20. Changes to this Privacy Policy
Biophilic Vision may update this Privacy Policy if the functions of Biophilic Vision Moments, the services used, or applicable legal requirements change.
